Kentucky House Judiciary Committee advances medical cannabis bill!

Seriously ill Kentuckians have been waiting long enough — urge your state legislators to support HB 136!

Today, Kentucky’s House Judiciary Committee voted 17-1 to pass HB 136, a bill that would legalize cannabis for medical use. Next the bill will proceed to the full House, where it is expected to receive a vote soon.

Please write your legislators today and urge them to pass this compassionate legislation!

Fifty-one of Kentucky’s 100 state representatives are cosponsors of HB 136, and Gov. Andy Beshear has indicated that he strongly supports medical cannabis.

However, some Senate leaders remain opposed, so the challenge for advocates will be getting a bill through both chambers of the legislature and to the governor’s desk.

It’s critical that legislators hear from their constituents who support medical cannabis. After you write your legislators, please share this message with your friends and family.

As of today, January 22, 2020, Senator Perry Clark has introduced SB 105, “AN ACT relating to the regulation of cannabis and making an appropriation therefor”, as is posted on the Kentucky Legislature site. 

To date, this is the best Bill which I have seen, as it supports all facets of Cannabis, including medicinal use for those under 21 if needed. 

Here is a paragraph of the Bill:

Create various new sections of KRS Chapter 245 to define terms; to allow for possession, growth, use, processing, purchasing, transfer, and consumption of cannabis; to establish limits for transfer; to allow for purchasing and manufacture of cannabis accessories; to authorize activities and operation of retail stores, consumption establishments, cultivation facilities, cannabis testing facilities, and product manufacturing facilities; to establish possession limits; to prohibit smoking cannabis in public and to establish a fine for violation; to prohibit operation of motor vehicles while consuming cannabis and to specify that existing intoxication laws are not superseded; to prohibit state or local resources to be used to investigate violations of federal Controlled Substances Act that conflict with this KRS Chapter 245; to specify that an employer is not required to allow consumption, workplace intoxication, possession, or transfer of cannabis; to prohibit individuals under the age of 21 from entering cannabis establishments, purchasing, using, or misrepresenting their age and to provide for exceptions; to establish provisions for palliative or therapeutic use of cannabis by persons under the age of 21  LINK

On Tuesday, November 5th, WE Must Be The Change In Kentucky! Vote HICKS/CORMICAN! This Is Why…

On Tuesday, November 5th, the most important election in Kentucky in many years is about to happen!

I am not here to argue with anyone.  I am here to present the facts and my opinion as I see it.

Therefore,

First of all, you must vote to see change!  If you are eligible to Vote and are registered to do so – You must VOTE!  It is your Civic Duty.  And if you are eligible to vote but did not register, shame on you!

IF you want a change in your Government, you have to vote for the people who will CHANGE the way things are being done in           Kentucky!

You CANNOT vote for a Democrat or Republican and expect anything to change – only to get worse!  So if that is what you want, then go for it!

Otherwise, BE THE CHANGE that Kentucky must have in order to succeed!  John Hicks and Ann Cormican – Libertarian are running for the most important office in the State.  That is where we must start!  At the top!

On November 1st, Rep. Jason Nemes prefiled this years “medical marijuana bill” for Kentucky.  It will become House Bill 136 when the Session opens in January, and if it passes we will once again become Slaves to the system!  A few points on the Bill as written are:

*  Department for Alcoholic Beverage and Cannabis Control to implement and regulate the medicinal marijuana program in Kentucky;

*  establish the Division of Medicinal Marijuana within the Department of Alcoholic Beverage and Cannabis Control;

establish restrictions on the possession of medicinal marijuana by qualifying patients, visiting patients, and designated caregivers;

*  establish certain protections for cardholders;

*  establish professional protections for practitioners; to provide for the authorizing of practitioners by state licensing boards to issue written certifications for the use medicinal marijuana;

*  establish professional protections for attorneys;

* prohibit the possession and use of medicinal marijuana while operating a motor vehicle;

to prohibit smoking of medicinal marijuana;

* to permit an employer to restrict the possession and use of medicinal marijuana by an employee;

*  to require the department to implement and operate a registry identification card program; to establish requirements for registry identification cards; to establish registry identification card fees; to require the department to operate a provisional licensure receipt system; to establish the application requirements for a registry identification card; to establish when the department may deny an application for a registry identification card;

*  establish certain responsibilities for cardholders; to establish when a registry identification card may be revoked;

*  establish various cannabis business licensure categories; to establish tiering of cannabis business licenses; to require certain information be included in an application for a cannabis business license; to establish when the department may deny an application for a cannabis business license;

*  to establish rules for local sales, including establishing the process by which a local legislative body may prohibit the operation of cannabis businesses within its territory and the process for local ordinances and ballot initiatives;

*  establish technical requirements for cannabis businesses;

to establish limits on the THC content of medicinal marijuana that can be produced or sold in the state;

*  to establish requirements for cannabis cultivators, including cultivation square footage limits; to establish requirements for cannabis dispensaries; to establish requirements for safety compliance facilities; to establish requirements for cannabis processors; to establish procedures for the department to inspect cannabis businesses;

to exempt certain records and information from the disclosure under the Kentucky Open Records Act;

*  to establish that nothing in the bill requires government programs or private insurers to reimburse for the cost of use; to establish the medicinal marijuana trust fund; to establish the local medicinal marijuana trust fund; and to establish procedures for the distribution of local cannabis trust fund moneys;

*  create a new section of KRS Chapter 138 to establish an excise tax of 12% for cultivators and processors for selling to dispensaries; to require that 80% of the revenue from the excise taxes be deposited into the medicinal marijuana trust fund; to require that 20% of the revenue from the excise taxes be deposited into the local medicinal marijuana trust fund; amend KRS 342.815 to establish that the Employer’s Mutual Insurance Authority shall not be required to provide coverage to an employer if doing so would subject the authority to a violation of state or federal law;

The above is not all inclusive of the regulations, and they will no doubt change again when it is introduced in January.  Read the Bill!

Please note that there are NO provisions for “smokable cannabis”, and NO mention of Children’s rights either.  There are NO provisions for growing your own plants, and this BILL in my opinion is being promoted for the Corporate/Pharmaceutical industry. 

Out of all the Bills previously submitted for “medical” or “adult use” Cannabis in Kentucky this is the worst one yet!  Do not fall for the legal lies which they are feeding you because they are preying on your fears for your Children’s needs, mostly.  The fact is, what M.D., is going to give you permission or a written statement that will give you the right to medicate your child with Cannabis?  The answer to that is virtually none, and if there was even one that WOULD do it there is no guarantee that you will be able to access that Physician!

The bill would prohibit the smoking of marijuana for medical purposes, but would allow other forms of consumption, such as edibles, oils and pills.  A 12% excise tax is proposed for cultivators and processors for selling to dispensaries.  LINK

I have consulted with several other Senior Activists in Kentucky over this issue and we all surmised basically the same opinions on the matter!  This is in NO way a repeal of prohibition of Cannabis and in no way will it ascertain our rights to this plant – medically or otherwise.  It is however, worth some $$$ to Corporate Ventures and Kentucky Government as it now stands!

In my opinion, for those parents who have seriously ill children in need of this medicine they need to consider moving to a honest medical cannabis State such as Colorado or elsewhere.  For those who are unable to do this due to financial situations we must set up a fund to enable them to do so.  I can honestly say that if it were my child that is exactly what I would do!  Not because I want to leave my home in Kentucky, but because my Childs life is more important and I would be compelled to do so, IF John Hicks and Ann Cormican are not elected. 

The “Undergreen Railroad” is one such organization.  I will look into this organization further, especially if Hicks/Cormican are not elected, because you all are going to need it!

Finally, we come to the third candidate in the governor’s race. Libertarian John Hicks. John is a Vietnam Era Army veteran, a former school teacher, and currently an IT consultant. He has a BA Degree in Political Science and History. He has never held political office, but ran previously for State Representative (District 43) in 2018. John is pro-life and believes government should stay out of personal issues.
John supports the legalization of marijuana, expanded gaming, and the development of hemp as sources of additional state revenue (better than raising taxes!). He also believes that the best way to compensate for budget shortfalls is to reduce the size of government and streamlining operations. Additionally, John Hicks supports election reform; specifically by introducing run-offs, using ranked choice voting, proportional representation, multi member districts which would end partisan gerrymandering.

Remember when Bevin said, “I guarantee you somewhere in Kentucky today a child was sexually assaulted that was left at home because there was nobody there to watch them.”? There also was mention of children trying drugs for the first time that day.

Remember when Bevin blamed the shooting of a 7 year old on a sickout?

Remember when Bevin was running for Governor the first time and he promised he would fight to get cannabis for those needing it. Then after getting elected he said legalizing marijuana creates homelessness, fills up ERs and isn’t a realistic option for Kentucky.

Remember Bevin claiming he would sign a medical marijuana bill during the 2019 legislative session knowing his current running mate wouldn’t allow it to be heard.

Remember when Bevin bought a $2.9 million property for $1.6 million from his friend, Neil Ramsey, who happened to also donate to his political campaign and be an investor in his company. Did I mention that Ramsey was then appointed to the Kentucky Retirement System Board of Trustees by Bevin? Did I also mention that the appraiser on that property is named John May. Bevin appointed May’s wife, Shellie May, as executive director of the Kentucky Commission of Children with Special Health Care Needs.

Remember when Bevin was the least popular governor in the US?

Remember when Bevin compared teachers to thugs and called us selfish and ignorant?

Remember when Bevin said, “It’s just straight up about wanting more than your fair share,” as he compared teachers to people who hoarded rationed goods during WWII?

Remember when Bevin said teachers and state workers weren’t sophisticated enough to really understand the pension bill?

Remember when Bevin took $201.5 million from the Kentucky Employees’ Health Plan to balance the budget?

Remember when he called high court justices incompetent?

Remember when Bevin intentionally withheld the actuary analysis that revealed that the retirement system would be fully funded by 2043 if it was unchanged but continued to be fully funded?

Remember when Bevin called our students “soft” because our school districts didn’t want kids to be outside in sub zero arctic temperatures?

Remember when Al Roker called him a nitwit?

Remember when Bevin hired his friend, Grindle, and then raised his salary from $160,000 to $375,000? That’s a $215,000 raise.

Remember when Bevin got elected and he reversed the states decision to raise the minimum wage.

Remember when Bevin’s Labor Cabinet said they will fine teachers $1000 for protesting?

Remember when Bevin approved SB 151 that deleted a $5,000 life insurance death benefit from police, fire fighters, teachers, and other state workers?

Remember when Bevin called a special session in December 2018 that wasted tax payers money to accomplish nothing.

Remember when he continues to try to call a special session this year, but doesn’t have the votes?

Remember when Bevin said it’s none of the tax payers business why he uses a plan owned by the tax payers.

Remember when Bevin’s running mate became the first ever African-American woman to hold an executive office in the state of Kentucky, to then be dumped when he ran for a second term?

Remember when Bevin publicly applauded the University of Kentucky’s men’s basketball team for advancing to the Elite 8, but said nothing about University of Louisville’s women’s team who did the same thing?

Remember when Bevin said the West Louisville chess club at Nativity Academy is ‘not something you necessarily would have thought of when you think of this section of town.’?

Remember when he proudly boasted about making all of his children contract chicken pox?

Remember when Bevin said, “It’s like saving a drowning victim, Brian. It’s like somebody — they’re fighting you, biting you, pulling you under. You just need to knock them out and drag them to shore. It’s for their own good and we have to save the system,” when talking about teachers who opposed to his pension plan.

Remember when Bevin said that teachers hoard sick days?

Remember when Bevin attended the Kentucky Derby and while an interview was occurring next to him on national television about the death of a trainer, he continued to be on his phone?

Remember when Bevin was late paying his property taxes?

Remember when Bevin cut dental and vision benefits for 460,000 Medicaid recipients?

Remember when people who don’t even live in Kentucky contacted you about something embarrassing Bevin had done or said that made it on national news coverage?

Remember when Bevin says, “We are Kentucky,” at the end of every speech, but he isn’t even from Kentucky?

The DEA is accepting comments on the rescheduling of Kratom into Schedule I until December 1st…The time to comment is NOW!

Due to be published in the “Federal Register” on August 31st, 2016 is the DEA’s “Intent to reschedule” the opioids mitragynine and 7-hydroxymitragynine  These are the “ingredients” of the plant Kratom and they are placing it into schedule I using the “temporary scheduling provisions” of the Controlled Substances ActLINK

The DEA reluctantly put on hold it’s intentions of placing Kratom into a Schedule I controlled substance category in August of 2016 after having such a backlash of individuals complaining about the proposed plans.  However, they are still contemplating that move and we only have until December 1st to make our comments through a website designed for us which states that this is …

An unknown number of people in the U.S. use Kratom daily to ease pain and withdrawal symptoms among other things.  It is a “plant” and it belongs to the “People”!  It is a part of our unalienable rights!

This is just the latest move by the DEA through the U.N. and “Agenda 21” to claim all of our rights to any substance that can possibly make the pharmaceutical companies more profitable in the future by denying access to this plant by the individual now.  In fact, a Patent application, dated 2009 exists already.

Scientific American published an article “Should Kratom Use Be Legal?” in 2013, which features an interview with Edward Boyer, a professor of emergency medicine and director of medical toxicology at the University of Massachusetts Medical School, which is a very good article concerning Kratom.  It is a good source of information for those who are not familiar with Kratom.  Ironically enough, it is the University of Massachusetts Medical School which is the “Assignee” on the above patent.  In addition, the following Patents are noted in 2016:

The “drug war” has taken enough of our plants and enough of our lives.  We cannot continue to let them regulate us out of every plant of food and medicine which were ever given to us as Our “inalienable rights” as Human Beings and laid out in Our Constitution.  I wrote an article concerning this in 2015, entitled, HOW THE UNITED NATIONS IS STEALING OUR “UNALIENABLE RIGHTS” TO GROW FOOD AND MEDICINE THROUGH THE U.N. Kentucky Senate Bill 136, in 2016, was defeated and did not take effect this year.  However, there are many other states in which it has been rescheduled to a I on a state level.  If we do not stop this from happening now, we will never be able to once it is Federally rescheduled.  So take a moment and make your opinion heard.  Use the Federal website to post your comment now!

It’s time for another Presidential Election in the U.S.A. (Lord, what are we supposed to do now?)

The following is a short synopsis of the current situation as I see it concerning the Presidential Elections.

After watching Donald J. Trump at the Republican National Convention (RNC) and Hillary Clinton at the Democratic National Convention (DNC) in July, I am still at a loss on who would be the best Candidate to put our Votes behind in the upcoming Presidential Elections. 

As of yet, the U.S. Marijuana Party as a group has likewise not decided who we should promote for the White House as well.

Bernie Sanders did his best at the DNC to push the Democrats over to Hillary Clinton, in his speech.  I am not sure how that is going to work out for them.

Hillary Clinton has had virtually continuous access to the White House since her Husband, Bill Clinton was elected President in 1993.  This is 2016 and I do not see anything that can be construed as positive changes for the American People in a long, long time.  You could argue that when “Bill” was in the White House things were different.  However, after gaining a few years wisdom on the matter, there are things that I could disagree with during his reign, that at the time I thought he was one of the best President’s we ever had.  And, sadly enough, he probably was.

Clinton was previously Governor of Arkansas from 1979 to 1981 and 1983 to 1992, and the Arkansas Attorney General from 1977 to 1979. A member of the Democratic Party, ideologically Clinton was a New Democrat, and many of his policies reflected a centristThird Way” political philosophy.

The Omnibus Crime Bill, which Clinton signed into law in September 1994,[87] made many changes to U.S. crime and law enforcement legislation including the expansion of the death penalty to include crimes not resulting in death, such as running a large-scale drug enterprise. During Clinton’s re-election campaign he said, “My 1994 crime bill expanded the death penalty for drug kingpins, murderers of federal law enforcement officers, and nearly 60 additional categories of violent felons.”[88] It also included a subsection of assault weapons ban for a ten-year period.

After having been in the public spotlight since Bill Clinton’s Election in 1992 and even prior to that in Arkansas, she has had plenty of time and plenty of access to all the most valuable areas in the Executive Branch of the Government and beyond to make change happen.

She also voted for the Iraq Resolution, which she later regretted.  She voted against the Bush tax cuts and in favor of the Patriot Act and TARP. Clinton responded to the Arab Spring, during which she advocated the U.S. military intervention in Libya.

She arguably has the most experience and the most activism experience as well, in her background.  But there has just been so much drama in her past decisions and she has been in the circle for 25 years already.  You can definitely argue that it is time for change.  Period.

It is different from both corporatism, which is the organisation of society into groups with common interests, and Corporatocracy, which is an economic and political system controlled by corporations or corporate interests while not being necessarily an Oligarchy.

Donald John Trump (born June 14, 1946) is an American businessman, television personality, author, and politician. He is chairman of The Trump Organization, which is the principal holding company for his real estate ventures and other business interests. He is also the presumptive nominee of the Republican Party for President of the United States in the 2016 election.

Disposal of national public lands;

The Republican platform committee met this week to draft the document that defines the party’s official principles and policies. Along with provisions on pornography and LGBT “conversion therapy” is an amendment calling for the indiscriminate and immediate disposal of national public lands

“Congress shall immediately pass universal legislation providing a timely and orderly mechanism requiring the federal government to convey certain federally controlled public lands to the states,” reads the adopted language. “We call upon all national and state leaders and representatives to exert their utmost power and influence to urge the transfer of those lands identified.”

We as a People cannot let this happen on our watch!  It must be stopped!  National Public Lands are supposed to belong to the People of this Country.  If they are sold off to Private investors the land will be at their mercy.

Cut spending by targeting the Department of Education and Environmental Protection Agency;

Asked on “Fox News Sunday” how he would cut spending, Trump named the Department of Education and the Environmental Protection Agency as potential targets.

Although I believe both “Departments” could use some restructuring I do not believe it is in anyone’s best interest, (except maybe the “Corporations”), to dispose of these Agencies.  They make an honest (?) attempt to regulate two of the most important “Departments” in the U.S.  Without them who would monitor the health of our environment or be responsible for our Children’s learning structure and environment?  While I would also say that private education is the best education and it would be nice if we could eradicate the Department of Education, it just does not seem viable to me to do so at this late date.  Our Children deserve to be educated to the best of the Student’s ability to learn.  Education should be free and equal to all Citizens as long as their participation in their education continues and passing grades are achieved.  This should include at least a basic four year College or University Curriculum. 

I do not claim to be all-knowing, but it sure seems like Trump’s Campaign is just another Corporate Coup to me!

Gary Johnson  (Libertarian)

no farm subsidies;

In my opinion, the Farmer’s are the very people that we should be subsidizing!  These are the very people who grow and produce our food!  The only reason for not subsidizing Farmer’s would be to let Corporate farming take over the market.  This may reduce the cost of food and maybe raise the quantity, but what quality of food would we be subjected to? 

Built private prisons to replace out-of-state prisoners;

There is only one reason to promote the use of private prisons and that is Corporate prisons.  Private prisons have been used for quite a few years and they have all been a failure.  Cost is not the only issue when it comes to housing our prisoners!  There are a lot of issues with private run prisons and there are a lot of links at KentuckyMarijuanaParty.Com to help you begin to sift through all those issues.  In short, I do not like them.

State primacy over water quantity & quality issues;

Water is our most important natural resource.  It is the lifeblood of the Human Race as a whole.  Water should be regulated first on a Federal level so as to ensure that all of the water which is utilized in our homes and for personal use, i.e., drinking and bathing is safe to use not only at the moment of consumption but so as not to cause health issues later.  I believe that Flint, Michigan is a very good example of what can happen when this resource is left untested – literally.

I am not a fan of the U.N. but it has “recognized the human right to water and sanitation and acknowledged that clean drinking water and sanitation are essential to the realization of all human rights.”  The U.S. should take this declaration seriously and strive fast and hard for the access to clean water to all Citizens in all areas of the U.S.  This should be a top priority!  Since clean, safe water is essential to all of us the Federal Government should set standards and do whatever is necessary to make sure all the States have equal access to whatever services they may require to make sure that this is accomplished.

NAFTA benefits New Mexico; jobs lost are those we don’t want;

Unlimited campaign contributions by corporations;

It is my opinion that only individuals should be able to contribute to any given campaign!  There should be no Corporate interests involved in any election!  We are talking about Government of the people, by the people and for the people, NOT the Corporations!  My belief is that a Corporation is not a ‘Being’ and should not be treated as such – It IS a business!  Businesses always have ulterior motives in any given Election – It is called Sales and Marketing strategy!

In a January 2001 interview with Playboy Magazine, Governor Johnson stated that he opposed campaign contribution limits. “The problem isn’t large contributions. The problem is that we don’t know who contributed. If you limit contributions from an individual to, say, $1000, then I think just the opposite occurs. Then you have politicians beholden to way too many people.” In 2010, Johnson said he favored unlimited contributions by corporations as well.

Gary Johnson on Social Security issues:  Raise the retirement age to 70 or 72;   A portion of Social Security ought to be privatized;  Reform all entitlements, including Social Security;  Open to personal accounts for Social Security;

 

Jill Stein –  (Green Party)

She wants to put much regulation into the ownership of guns which I see as a threat against an important part of our Constitutional Rights.

According to Jill Stein:

  • Gun ownership should be appropriately regulated.
  • Gun ownership should be appropriately regulated. 

She must have really strong feelings about this issue since it was inputted twice!

  • More local regulations; more background checks. 

Personally, I do not think we need any regulations in gun ownership.  At this point everyone needs to own one and know how to use it.  Regulations are not going to save your Ass when an intruder decides to do you harm.  The intruder will not read the rules and regulations, I promise you that much!

  • Reduce culture of violence via mental health & legal drugs. 

This is very troubling to me as an individual because forced health care, especially mental health care, is a very slippery slope which can and most likely will turn into a disaster for many patients.  Who gets to decide who needs mandated mental health care?  We already have too much of this type of scenario playing out in the Courts currently.  There is a BILL, H.R. 2646 which was passed out of Committee on June 15, 2016 deemed “Murphy’s Bill” which could very likely be the slippery slope that could lead into a very dire situation for any patient involved in the mental healthcare system. 

In my opinion, the best way to get mental help patients the care that they need is to make sure that Physicians and services are available with easy access.  If a patient feels good about the Physician that they are seeing and has ready access to those services it is a good bet that they will be open to receiving those services.  We cannot mandate healthcare.  If a patient has no right to choose whether or not he receives care then he has no right to determine who or where he receives the care from and what pharmaceutical drugs he may be mandated or forced to take!  This Bill could possibly be a big winner for the pharmaceutical industry as well as the drug testing industry!

History tends to repeat itself, so with that in mind take a look at this historical information and do not ever think that it could not happen here, because it damn sure could!

  • Address community violence with more mental health services.

Again, we cannot mandate mental healthcare!

  • Gun at home more likely to cause injury than to defend home.

This may or may not hold true but it is still a Constitutional right to own firearms and we have a right to protect ourselves, our families and our homes – as well as to help protect anyone within our reach.  It is an individual choice whether or not to keep a firearm in your home. 

With all this being said, it remains who would be the most trustworthy of the Candidates, let alone who would be the best leader of our Country.  Who can we trust the most to do what they say they will do?  Who would be most likely to lead us into a massive war?  Who would be most likely to take away even more of our individual rights through the guise of homeland security and gun control?  There are so many issues at the front of this upcoming Election.  I will continue to listen to the reports, and hopefully, come to a final decision soon,  but this will have to have been the hardest Election that I’ve ever had to make a decision on.
